These terms govern your use of manx.directory (the “site”), operated by OLXR Limited (“we”, “us”), a company registered in the Isle of Man (company number 133388C, registered office 61 Port-E-Chee Avenue, Douglas, IM2 5EU, Isle of Man). manx.directory is a business name registered in the Isle of Man (number 031885B) to OLXR Limited; your agreement is with OLXR Limited.
By using the site or listing a business, you agree to these terms. If you don’t agree, please don’t use the site.
Using the directory
- You may browse and search the directory freely.
- Don’t misuse the site: no attempts to disrupt, overload or gain unauthorised access, and no unlawful use.
- Scraping, harvesting or bulk-copying listing data is not permitted. We may block access, and we’ll pursue whatever legal remedies are available - including under copyright and database right - where someone does it at scale or commercially.
- The directory as a whole, including its structure, categories, editorial content and design, belongs to us and is not for resale or redistribution.
- Not every image is ours. Photographs of Manx towns and places are used courtesy of Visit Isle of Man, photographs and logos on a business listing belong to that business, and map data comes from OpenStreetMap - see “Where listing data comes from” below. If we’ve used an image of yours without permission, tell us and we’ll replace it.
- We don’t sell or licence listing data, and the directory isn’t a data product. If you think you have a good reason to use some of it, ask us rather than scraping.
Where listing data comes from
Every listing is created and managed by the business owner, or by someone authorised to act for them. We don’t seed listings from public databases and we don’t scrape them from anywhere else.
Maps and address lookup on the site use OpenStreetMap, an openly licensed geographic database. That map data is © OpenStreetMap contributors, available under the Open Database Licence, and is separate from the listings themselves.
If your business appears on the site and you didn’t put it there, you can ask us to correct it or remove it. Use the report link on the listing, or the contact form. Both are free, and we check each request by hand. If you’d rather have the listing yourself, we’ll remove it and you can add your own.
Listing a business
- You must be the owner of, or authorised to represent, the business you list.
- It must be a genuine, trading business, and its details must be accurate and kept reasonably up to date.
- No impersonation, spam, or unlawful, misleading or offensive content.
- Don’t upload anything you don’t have the rights to, including photographs and logos.
- New listings are reviewed before going live, and we may edit, hold or remove any listing or content that breaks these terms or the law. We aim to review within 24 to 48 hours but don’t guarantee a timeframe.
- You keep ownership of your content. You grant us a non-exclusive, royalty-free licence to host, store, reproduce and display it on the site and in related promotion of the directory, for as long as your listing is live. This licence ends when the listing is removed, apart from copies retained in backups or where we’re required to keep records.
Your account
- Accounts use passwordless, link-based sign-in. Keep access to your email secure - it controls your listing.
- You’re responsible for the content you publish through your account, and for anyone you allow to use it.
- Tell us promptly if you think someone else has gained access to your account.
- We may suspend or close accounts that break these terms.
Promotion (paid)
- Listing is free. Promotion is an optional paid extra that gives your listing top placement in its category and access to visitor statistics.
- Payments are handled by Paddle.com Market Limited, our authorised reseller and merchant of record. Paddle is the seller for the purposes of the transaction, its buyer terms also apply, and your receipt or invoice comes from Paddle.
- Promotion is a recurring subscription that renews automatically until cancelled. The current price and the applicable tax are shown at checkout before you commit.
- You can cancel at any time from your dashboard. Cancellation takes effect at the end of the current billing period. Your listing stays live and free afterwards - cancelling promotion doesn’t delete your listing.
- You can get a full refund of any payment within 14 days of it being taken. Refunding a payment ends the subscription. Full detail is in our refund policy.
- We may change the price of promotion. Existing subscribers will be given at least 30 days’ notice before a price change applies to their subscription, and can cancel before it takes effect.
- We may suspend or end promotion if the underlying listing breaks these terms. Where we do that because of something you’ve done, the payment for the current period isn’t refunded.
- We may decline to sell promotion, or refuse a future subscription, where there’s evidence of fraud, chargeback abuse, or repeated use of our refund guarantee to obtain promotion without paying for it. Your free listing isn’t affected.
Availability and liability
We work hard to keep the site accurate and available, but we provide it “as is”. We don’t guarantee uninterrupted availability, and we don’t guarantee that every listing is accurate or current. The information in a listing - opening hours, contact details, what a business does - is supplied and maintained by that business, not by us. We review new listings before they go live, but that is a check against these terms and the law rather than a verification that every detail is correct. Check anything that matters with the business itself.
The site may link to third-party websites. We’re not responsible for their content, products or practices.
To the fullest extent permitted by law, we’re not liable for any loss arising from your use of the site or your reliance on a listing, including lost profits, lost business, or indirect or consequential loss.
Where you’ve paid us for promotion, our total liability to you for any claim connected with the site is limited to the amount you paid in the 12 months before the claim arose.
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that can’t be limited by law. If you’re a consumer, nothing here affects your statutory rights.
Suspension and termination
You can stop using the site at any time and ask us to delete your account and listing.
We may suspend or withdraw the site, or your access to it, if you break these terms, or where we reasonably need to for legal, security or operational reasons. Where the reason is a breach by you, we’ll normally give you a chance to put it right first unless the breach is serious.
Changes
We may update these terms from time to time. The current version always lives on this page, with the date it was last updated. Significant changes affecting your listing or subscription will be notified by email where reasonable, and will take effect no sooner than 30 days after notice for existing subscribers.
General
- If any part of these terms is found to be unenforceable, the rest continues to apply.
- If we don’t enforce a term straight away, that doesn’t mean we’ve given up the right to do so.
- These terms are between you and us. Nobody else has rights to enforce them.
- We may transfer our rights and obligations under these terms to another business, for example if we sell or reorganise the company. Your rights won’t be affected.
Governing law
These terms are governed by the law of the Isle of Man, and disputes are subject to the exclusive jurisdiction of the Isle of Man courts.
